These Terms of Service (“Terms”) govern your access to and use of the FastHire website located at https://www.thefasthire.com, the FastHire software platform, mobile applications (if applicable), APIs, integrations, artificial intelligence services, and all related products and services (collectively, the “Services”). The Services are owned and operated by FastHire Manpower Solution (“FastHire,” “we,” “our,” or “us”). By accessing, browsing, registering for, purchasing, or otherwise using any part of the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, together with our Privacy Policy, Data Processing Agreement (where applicable), and any additional agreements incorporated by reference. If you do not agree to these Terms, you must not access or use the Services. If you are accepting these Terms on behalf of a company, employer, recruitment agency, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

Certain features or services may be governed by additional terms, subscription agreements, or order forms. In the event of any conflict, those agreements will prevail with respect to the applicable service.
For the purposes of these Terms:
"Account" — A registered user account created to access the Services.
"AI Services" — Artificial intelligence, machine learning, natural language processing, large language models, automation tools, recommendation systems, ranking algorithms, workflow automation, and other AI-powered capabilities provided through the Services.
"Authorized User" — Any individual authorized by a Customer to access or use the Services under the Customer’s account.
"Candidate" — Any individual whose professional information, application, résumé, employment history, profile, or recruitment-related information is processed through the Services.
"Customer" — Any employer, recruitment agency, staffing company, business, organization, or other entity that subscribes to or uses the Services.
"Customer Data" — All information, content, documents, Candidate information, communications, configurations, job postings, resumes, files, or other materials uploaded, submitted, imported, synchronized, generated, or otherwise processed by or on behalf of a Customer through the Services.
"Documentation" — Any user guides, technical documentation, support materials, API documentation, tutorials, or other materials provided by FastHire relating to the Services.
"Intellectual Property Rights" — All patents, copyrights, trademarks, trade secrets, database rights, moral rights, know-how, software, algorithms, AI models, source code, object code, inventions, designs, confidential information, and all other proprietary rights recognized under applicable law.
"Services" — The FastHire website, SaaS platform, APIs, mobile applications (if any), artificial intelligence features, integrations, support services, analytics, automation tools, and related products offered by FastHire.
"Subscription" — The Customer’s right to access and use the Services during the applicable subscription period in accordance with these Terms and any applicable order or subscription agreement.
"Third-Party Services" — Any products, software, APIs, websites, applications, AI providers, cloud providers, communication platforms, calendar providers, Applicant Tracking Systems (ATS), Human Resource Information Systems (HRIS), payment processors, analytics services, or other services not owned or operated by FastHire.
"User" — Any person accessing or using the Services, including Customers, Authorized Users, Recruiters, Hiring Managers, Candidates, or website visitors.
To use the Services, you represent and warrant that:
FastHire may refuse, suspend, or terminate access where it reasonably believes these requirements are not met.
FastHire is an AI-powered recruitment platform that assists organizations in managing and automating recruitment activities.
Depending on the subscription plan and enabled features, the Services may include:
FastHire continuously develops and improves the Services and may modify, enhance, replace, or discontinue features from time to time.
FastHire uses artificial intelligence to assist Customers with recruitment-related activities. AI functionality may include:
AI-generated outputs are intended solely to assist users and should not be considered professional, legal, employment, or human resources advice.
Customers remain solely responsible for:
FastHire does not guarantee the accuracy, completeness, legality, fairness, or suitability of AI-generated content for any particular purpose.
FastHire may, from time to time, offer beta, preview, experimental, early access, or pre-release features ("Beta Features").
Beta Features are provided for evaluation purposes and may:
Unless otherwise agreed in writing, Beta Features are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
Customers use Beta Features at their own discretion and risk.
To access certain features of the Services, Users must create an Account. When creating an Account, Users agree to:
Users are responsible for all activities that occur under their Accounts unless caused by FastHire’s breach of its security obligations.
FastHire may require identity verification, administrative approval, or additional security measures where appropriate.
Users must take reasonable steps to safeguard their login credentials and prevent unauthorized access. FastHire recommends:
FastHire is not responsible for losses resulting from a User’s failure to maintain reasonable account security.
Customers are responsible for:
Customers are solely responsible for all hiring decisions, employment actions, and communications made through or with the assistance of the Services.
Subject to these Terms, any applicable Order Form, and payment of all applicable fees, FastHire grants the Customer a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services during the applicable Subscription Term solely for the Customer’s internal business and recruitment purposes.
This license does not transfer any ownership rights in the Services or any FastHire Intellectual Property.
Except as expressly permitted under these Terms, Customers may not:
Customers retain all rights, title, and interest in and to Customer Data. Customer Data may include, without limitation:
FastHire does not claim ownership of Customer Data. Customers are solely responsible for:
To provide the Services, the Customer grants FastHire a limited, worldwide, non-exclusive, royalty-free license to host, copy, transmit, process, display, analyze, index, back up, and otherwise use Customer Data solely for the purposes of:
This license automatically terminates when the Customer Data is deleted from the Services, except to the extent retention is required by law or under applicable contractual obligations.
Customers are responsible for ensuring that:
Customers remain solely responsible for: employment decisions; candidate communications; compliance with employment laws; anti-discrimination obligations; and recruitment practices.
FastHire does not act as the employer, recruiter of record, employment agency, or hiring decision-maker.
Customers and Users agree to use the Services responsibly and only for lawful purposes. Users may use FastHire to:
Users must use reasonable care when processing Personal Information through the Services. See our separate Acceptable Use Policy for the full list of permitted and prohibited uses.

Customers acknowledge that they are responsible for ensuring Candidate information is collected, imported, and processed lawfully. Customers are responsible for:

The Services may assist Customers in identifying publicly available professional information relating to Candidates. Such information may originate from:
Customers remain responsible for ensuring their use of such information complies with applicable laws and the terms governing those third-party platforms.
FastHire does not guarantee the accuracy, completeness, currency, or availability of information obtained from third-party sources.
The Services may integrate with third-party services including:
Use of third-party services is governed by the terms and privacy policies of those providers. FastHire is not responsible for third-party outages, changes made by third-party providers, third-party data loss, third-party security incidents, or third-party terms or policies.
Customers authorize FastHire to exchange information with connected third-party services as necessary to provide requested functionality.
FastHire and its licensors retain all rights, title, and interest in and to the Services and all related Intellectual Property Rights. This includes:
Except for the limited license expressly granted under these Terms, no rights are transferred to Customers.
Customers may voluntarily provide suggestions, enhancement requests, ideas, recommendations, or feedback regarding the Services. Unless otherwise agreed in writing: FastHire may freely use, modify, incorporate, and commercialize such feedback without restriction; no compensation shall be owed; and feedback shall not be treated as confidential unless expressly agreed.
Access to the Services is provided under the Subscription Plan selected by the Customer. Subscription plans may vary based on:
FastHire may introduce, modify, or discontinue subscription plans at its discretion. Existing Customers will generally retain their agreed commercial terms until renewal unless otherwise agreed.
Customers agree to pay all applicable fees associated with their Subscription. Unless otherwise agreed:
Payments may be processed by third-party payment providers selected by FastHire based on the applicable region.
FastHire may offer free trials, demonstrations, proof-of-concept environments, or evaluation access. Unless otherwise stated:
FastHire uses commercially reasonable efforts to make the Services available on a reliable and consistent basis. However, the Services may be temporarily unavailable due to:
Unless expressly agreed in a separate written Service Level Agreement ("SLA"), FastHire does not guarantee uninterrupted or error-free availability of the Services. FastHire may perform maintenance at times intended to minimize disruption whenever reasonably practicable.
FastHire may provide technical support through one or more communication channels, including email, live chat, help center, knowledge base, video meetings, or other support channels designated by FastHire.
Support availability, response times, and service levels may vary depending on the Customer’s subscription plan or separate written agreement.
FastHire will use commercially reasonable efforts to resolve reported issues but does not guarantee resolution within any specific timeframe unless expressly agreed in writing.
FastHire may suspend or restrict access to all or part of the Services immediately, with or without prior notice, where reasonably necessary to:
Where reasonably practicable, FastHire will notify the affected Customer and work toward restoring access once the issue has been resolved.
Either party may terminate the applicable Subscription in accordance with the governing subscription agreement or applicable Order Form.
FastHire may terminate or suspend access immediately if:
Termination does not relieve either party of obligations that accrued before termination.
Upon termination or expiration:
Where technically feasible and contractually applicable, Customers may request export of Customer Data before account closure, subject to applicable agreements and legal obligations.
Each party agrees to protect the Confidential Information of the other party using at least the same degree of care it uses to protect its own confidential information, and no less than a reasonable standard of care.
Confidential Information includes any non-public information disclosed by one party to the other, including business information, technical information, Customer Data, product roadmaps, pricing, security information, source code, AI methodologies, product documentation, and trade secrets.
Confidential Information does not include information that is publicly available through no breach of these Terms; was lawfully known before disclosure; is independently developed without use of Confidential Information; or is lawfully obtained from another source without confidentiality obligations.
Where disclosure is required by law, the receiving party may disclose only the portion legally required and, where permitted, provide prior notice to the disclosing party.
FastHire warrants that it will provide the Services using commercially reasonable care and skill.
Except as expressly stated in these Terms or a separate written agreement, the Services are provided "AS IS" and "AS AVAILABLE." To the maximum extent permitted by applicable law, FastHire disclaims all implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, compatibility, and continuous operation.
FastHire does not warrant that the Services will be uninterrupted or error-free; that AI-generated outputs will always be accurate, complete, or suitable for hiring decisions; that third-party integrations will remain continuously available; or that candidate information obtained from third-party sources will be current or complete.
Customers acknowledge that recruitment decisions involve human judgment and should not rely solely on AI-generated recommendations.
To the maximum extent permitted by applicable law: FastHire shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including but not limited to:
FastHire’s aggregate liability arising out of or relating to the Services shall not exceed the total fees paid by the Customer to FastHire during the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.
The Customer agrees to defend, indemnify, and hold harmless FastHire, its affiliates, directors, officers, employees, contractors, licensors, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising from or relating to:
FastHire will provide reasonable notice of any indemnified claim and cooperate with the Customer, at the Customer’s expense, in the defense of such claim.
Neither party shall be liable for delays or failures to perform resulting from events beyond its reasonable control, including natural disasters, floods, fires, earthquakes, epidemics or pandemics, war, terrorism, civil unrest, government actions, internet failures, utility outages, labor disputes, cybersecurity incidents affecting third-party infrastructure, and cloud provider outages.
The affected party shall use commercially reasonable efforts to resume performance as soon as practicable.
FastHire continually improves its Services. Accordingly, FastHire may introduce new features, modify existing features, remove obsolete functionality, update user interfaces, change AI models or providers, and improve security or performance.
FastHire will use commercially reasonable efforts to avoid material disruption to Customers.
FastHire may update these Terms from time to time. Material changes will become effective upon the date specified in the updated Terms or as otherwise communicated. Where required by applicable law, FastHire will provide appropriate notice before material changes become effective.
Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
The Customer agrees not to use the Services in violation of applicable export control laws, sanctions regulations, or trade restrictions. The Customer represents that it is not subject to any sanctions or restrictions that would prohibit FastHire from providing the Services.
The Customer may not assign or transfer its rights or obligations under these Terms without FastHire’s prior written consent. FastHire may assign these Terms in connection with a merger, acquisition, corporate restructuring, financing, or sale of substantially all of its assets.
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be interpreted to reflect the original intent as closely as possible while remaining enforceable.
Failure by either party to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by the party granting the waiver.
These Terms, together with the Privacy Policy, applicable Order Forms, Subscription Agreements, Data Processing Agreement (where applicable), and any other documents expressly incorporated by reference, constitute the entire agreement between the parties regarding the Services and supersede all prior or contemporaneous agreements relating to the subject matter.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts in Ahmedabad, Gujarat, India, unless otherwise required by applicable law or agreed in writing between the parties.
